Surplus funds or overages are created when a property is sold at a foreclosure or tax sale auction for more than what was owed to the bank. These funds belong to the homeowner, as long as there is no other debt on the property.

What do you charge for your services?

We do not charge any upfront fees, we work on a contingency basis and are only paid if and when we recover funds for you.

Do I need to use a company to recover the funds for me?

We would not recommend going about this process without the knowledge of how the process works or where to even start. Not to mention that you may incur up front out of pocket expenses. Even though working with a company is not necessary, most people choose to work with an experienced professional, rather than trying to figure it out on their own and dealing with all the financial and emotional stress. What are state funds?

How long will this process take?

Every case is not the same, so there isn't an exact time line as to when you will get your money. For cases that are not complicated on average it will be about six months, possibly less. For cases that are more complicated a good time frame would be six to twelve months, possibly longer. Dispute Resolution:

Subject to any exceptions specified in these Terms and Conditions, if you and Midnight Assest Recovery LLC are unable to resolve any dispute through informal discussion, then you and Midnight Asste Recovery LLC agree to submit the issue before an arbitrator. The decision of the arbitrator will be final and binding. Any arbitrator must be a neutral party acceptable to both you and Midnight Asset Recovery LLC. The cost of any arbitration will be shared equally between you and Midnight Asset Recovery LLC.

Notwithstanding any other provision in these Trems and Conditions, you and Midnight Asset Recovery LLC agree that you both retain the right to bring an action in small claims court and to bring an action for injuctive relief or intellectual property infringement.

Severability:

If at any time in the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisionswill be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affwcted by the removal and the rest of these Terms and Conditions will still be considered valid.
